A commissioner of oaths is a person in Ontario who is legally authorized to take affirmations and oaths. Sometimes the law requires a person to take an oath before testifying or signing certain documents. The commissioner of oaths will direct the declaration or oath promising the truth, then signing the document that ensures that the oath was given and that the signatures on the paper are from the people before him/her. The commissioner of oaths must watch the document being signed and then compare the signature to a piece of identification that must be provided. A commissioner of oaths is only responsible to ensure the person has said the oath before signing the document. They are not legally responsible for any information in the document that is not true. A commissioner of oaths has an ethical responsibility to act fairly and follow the governing laws in Ontario but if an ethical issue arises they are allowed to refuse to give the oath. A commissioner of oaths cannot act for an immediate family member.
